Acceptance of Terms
By accessing or using Obsidian Labs AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including account holders, administrators, and any other individuals who access the Service through your account.
Description of Service
Obsidian Labs AI provides an AI-powered call handling platform that answers, transcribes, qualifies, and routes inbound telephone calls on behalf of businesses. The Service includes a web-based dashboard, call analytics, appointment scheduling integrations, and related features as described on our website. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
Account Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at support@obsidianlabs.ai.
Acceptable Use
You agree to use the Service only for lawful business purposes. You may not use the Service to conduct fraudulent activities, transmit spam or unsolicited communications, violate any applicable telemarketing laws, record calls without proper consent where required by law, or interfere with the Service's infrastructure. Violation of these restrictions may result in immediate account termination.
Call Recording Compliance
You are solely responsible for complying with all applicable federal, state, and local laws regarding call recording and monitoring, including obtaining required consents from call participants. Obsidian Labs AI provides tools to add disclosure announcements to calls, but compliance remains your responsibility. We are not liable for any claims arising from your failure to obtain required consents.
Payment and Billing
Subscription fees are billed monthly or annually in advance based on your selected plan. All fees are non-refundable except as required by law or as stated in our refund policy. We reserve the right to change our pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
Intellectual Property
The Service, including its software, design, and content, is owned by Obsidian Labs AI and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.
Limitation of Liability
To the maximum extent permitted by law, Obsidian Labs AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including lost revenue, missed calls, or business interruption. Our total liability to you shall not exceed the fees paid by you in the three months preceding the claim.
Termination
Either party may terminate the Service at any time. You may cancel your subscription from your account dashboard. We may suspend or terminate your account for violation of these Terms with or without notice. Upon termination, your access to the Service will cease and your data will be retained for 30 days before deletion, unless you request earlier deletion.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in a class action lawsuit.
